A drug possession case drew not only a $75,000 bond, but also a sly comment from Crawford County Common Pleas Court Judge Sean Leuthold Tuesday afternoon.
Thirty-nine-year-old David Charlton, who is listed as homeless in court records, was arraigned on a fifth-degree drug possession felony.
Charlton was arrested by Bucyrus police on Oct. 9 near Washington Square. Officers found two paper bindles of heroin in Charlton’s socks.
Charlton, who was intoxicated, allegedly told officers that he was “just chilling.” When an EMS squad arrived, he allegedly admitted to drinking and taking pain medicine.
“Chillin’ like Bob Dylan?” Leuthold asked then laughed and ordered Charlton to not answer the question.
Kyle McClintock pleaded guilty to an amended charge of possession of drug paraphernalia, a fourth-degree misdemeanor.
The judge indicated that the charge was based on an overdose incident which led attorneys from both sides to argue whether it fell under Ohio’s overdose law. The discussion eventually ended with the original drug possession charge being amended to a misdemeanor drug paraphernalia charge.
McClintock was sentenced to the maximum 30 days in the county jail, which he has already served.
