COLUMBUS, OH (CRAWFORD COUNTY NOW)—As football season kicks off, so does tailgating season in parking lots across Ohio. The Ohio Department of Commerce’s Divisions of Liquor Control and Cannabis Control are urging Ohioans to make safe, responsible, and legal decisions regarding alcohol and cannabis use leading up to game day.

Tailgaters must adhere to Ohio’s underage and open container laws. Alcohol consumption is prohibited in public places outside of a liquor permit holder’s premises or the boundaries of a Designated Outdoor Refreshment Area (DORA) during its active hours. Individuals convicted of providing alcohol to those under 21 can face up to six months in jail and/or a $1,000 fine per offense.

With the recent launch of non-medical cannabis sales in Ohio, residents are reminded that using non-medical cannabis in public areas is a minor misdemeanor. Similar to alcohol, cannabis use by individuals under 21 is prohibited, and providing cannabis to minors can result in fines and possible jail time. Ohio’s law also prohibits smoking or vaping marijuana in public indoor spaces, and operating a vehicle under the influence of cannabis is illegal.

Individuals should review policies regarding alcohol and cannabis that may impact their tailgating location. “We hope that as Ohioans prepare to cheer their favorite team on to victory, they do so with responsibility and safety in mind,” said Division of Liquor Control Superintendent Jackie DeGenova. “We also remind our permit holders to do their part to help keep safe Ohioans who visit their establishments.”

Division of Cannabis Control Superintendent Jim Canepa added, “We encourage individuals who choose to use non-medical cannabis to do so with safety in mind, both for themselves and those around them. Understanding state law and following policies related to public cannabis use will help ensure everyone’s safety and well-being.”

Ohioans 21 and over are reminded to eat plenty of food and drink water before consuming alcohol. They should also plan to get home safely by using a designated driver, rideshare, or public transportation services. Liquor permit holders are reminded to not serve anyone underage or already intoxicated and to always check IDs, especially at the point of sale.
